Terms of Service

These Terms of Service form the agreement that governs your access to and use of Sukidata's websites, applications, APIs, and related services.

1. Agreement and eligibility

These Terms of Service are an agreement between Sukidata and the person or entity that accesses or uses our services. By creating an account, accessing our websites or applications, using an API, or otherwise using Sukidata, you agree to these terms and the Privacy Policy. If you do not agree, you may not use the services.

If you use Sukidata for a company or other organization, you confirm that you have authority to bind it, and “you” includes that organization. You must be at least 18 years old, legally able to enter into this agreement, and not prohibited by applicable law from using the services.

2. Accounts and workspaces

You must provide accurate account information, keep credentials and API keys confidential, and promptly report suspected compromise. You are responsible for activity performed through your account and for configuring workspace members with appropriate access.

Accounts and access rights may not be sold, rented, shared publicly, or used to conceal the identity of a prohibited user.

3. Description of the services

Sukidata provides developer services for collecting and delivering structured public web data. The services include our websites, applications, APIs, documentation, data-delivery features, and related support services.

The product description, documentation, usage limits, pricing or checkout terms, and any order form presented to you form part of the agreement for the applicable service. We may improve or change endpoints, fields, limits, delivery methods, cache behavior, and retention periods. A signed order form or written agreement controls if it expressly conflicts with these terms.

4. Credits and usage

Sukidata may measure usage in credits. A request can consume credits according to the product and parameters used, including when a downstream result later proves incomplete or a third-party page changes. Cache hits, failed work, retries, expiration, and promotional grants are handled as described in the current product documentation or offer.

Credits are service units, not stored value, currency, or property. Free and promotional credits have no cash value, are not transferable, and may expire. A temporary negative credit balance or delayed usage update does not create a right to additional service and may prevent new requests until the balance is restored.

5. Acceptable use

You may use Sukidata only for lawful purposes and in a way that respects third-party rights and the stability of our systems. You must not use or help others use the service to:

  • Violate law, sanctions, court orders, contractual restrictions, privacy rights, intellectual-property rights, or website access controls.
  • Collect sensitive personal data unlawfully, target or profile children, facilitate surveillance or discrimination, or cause physical, financial, or reputational harm.
  • Distribute malware, phishing, spam, deceptive content, fraud, credential theft, or other abusive material.
  • Overload, probe, reverse engineer, bypass limits, evade suspension, resell unauthorized access, or interfere with Sukidata or its providers.
  • Misrepresent the source, freshness, completeness, or legal status of returned data, or use it to make solely automated high-impact decisions without appropriate review.

6. Your requests, data, and responsibilities

You retain your rights in requests, configurations, and other content you submit. You grant Sukidata the limited rights needed to host, process, transmit, and reproduce that content to provide, secure, support, and improve the service.

You are responsible for the legality of each request, your instructions to us, the permissions needed to process returned data, and how you use or share results. Sukidata does not grant rights to third-party pages, search results, trademarks, or content.

7. Sukidata intellectual property

Sukidata and its licensors retain all rights in the service, software, APIs, documentation, branding, and improvements. Except for the limited right to use the service under these terms, no rights are transferred to you.

If you provide feedback, you permit us to use it without restriction or payment, provided we do not identify you publicly without permission.

8. Third-party services and content

Sukidata depends on third-party networks, search services, identity providers, hosting, proxies, and other infrastructure. Their availability, rules, and content are outside our control. Links and returned content are provided for convenience and do not imply endorsement or a guarantee of accuracy.

9. Fees, taxes, and refunds

Fees, included usage, billing intervals, currencies, renewal terms, and applicable taxes for paid services are stated on the applicable pricing or checkout page or in an order form. The terms of an accepted order form govern that purchase if they differ from the general pricing shown on the website.

Payments may be handled by third-party payment providers and are also subject to their applicable terms. By completing a purchase, you authorize Sukidata and its payment providers to collect the stated charges using your selected payment method. You are responsible for keeping billing information current and for applicable taxes other than taxes on Sukidata's income.

Except where required by law or expressly provided in an order form or the Refund Policy, paid fees and purchased credits are non-refundable. A recurring subscription renews under the terms disclosed at purchase until it is canceled before the next renewal date.

10. Changes and availability

We work to keep Sukidata reliable, but do not promise uninterrupted or error-free service unless a separate service-level agreement says otherwise. We may maintain, modify, limit, or discontinue features for security, legal, provider, capacity, or product reasons.

We will try to give reasonable notice of material changes that adversely affect paid use when circumstances allow.

11. Suspension and termination

You may stop using Sukidata at any time. We may suspend or terminate access when we reasonably believe there is abuse, security risk, non-payment, legal exposure, breach of these terms, or harm to the service or others. Urgent cases may require action without advance notice.

On termination, your right to use the service ends. Provisions concerning ownership, payment, disclaimers, liability, disputes, and obligations that by nature should survive will remain in effect.

12. Disclaimers

To the fullest extent permitted by law, Sukidata is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing.

We do not warrant that third-party pages will be reachable, that a result will match what another user sees, or that returned content is complete, current, accurate, lawful, or suitable for a particular decision.

13. Limitation of liability

To the fullest extent permitted by law, neither Sukidata nor its suppliers will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption.

Our aggregate liability arising from the service will not exceed the amount you paid Sukidata for the service giving rise to the claim during the three months before the event. If you paid nothing, the cap is US$100. These limits do not apply where they are prohibited by law.

14. Indemnity

To the extent permitted by law, you will defend and indemnify Sukidata and its personnel against third-party claims arising from your requests, content, unlawful use, infringement of rights, or breach of these terms. We will provide reasonable notice and cooperation, and you may not settle a claim in a way that admits fault or imposes obligations on us without consent.

15. Disputes and general terms

Please contact support@sukidata.com first so we can try to resolve a dispute informally. Any governing law or forum stated in an applicable order form controls to the extent permitted; otherwise applicable law and mandatory jurisdiction rules apply.

These terms, the policies they reference, and any applicable order form are the entire agreement for the service. If one provision is unenforceable, the rest remain effective. A failure to enforce a provision is not a waiver. You may not assign this agreement without consent; we may assign it as part of a reorganization, financing, or transfer of the service.

16. Changes and contact

We may update these terms as the service or law changes. We will revise the date above and provide additional notice when required. Continued use after an updated version takes effect means you accept it; if you do not agree, stop using the service.
